This Privacy Policy explains how we collect, use, hold and disclose personal information in the course of carrying out our real estate business, including residential sales, leasing, property management, marketing and related services.

We collect and handle personal information as part of our obligations as a licensed real estate agency operating in New South Wales and Victoria, and in accordance with the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth), together with applicable state-based property legislation and regulatory requirements, and our obligations under the Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) legislation administered by AUSTRAC.

  1. What is Personal Information?

“Personal information” is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not and whether it is recorded in material form.

Personal information we may collect includes, but is not limited to:

  • Name, address, email address and telephone number
  • Date of birth and identification details and other information obtained for customer due diligence and risk assessment purposes
  • Financial information, including bank account details and other information relating to the source of funds or source of wealth where required by law
  • Employment or occupation details
  • Property ownership or authority to act, tenancy and transaction information
  • Images, video and marketing material of properties
  • Communications with our office

We usually collect personal information directly from you when you:

  • Enquire about buying, selling, leasing or renting a property
  • Engage us to act as your selling agent or property manager
  • Attend open homes, inspections or auctions
  • Complete forms or submit enquiries via our website
  • Communicate with us by phone, email or in person
  • Participate in promotions, competitions or marketing campaigns

We may also collect personal information from third parties where reasonably necessary, including:

  • Other real estate agencies
  • Referrers and service providers
  • Credit reporting bodies (where applicable)
  • Publicly available records

We collect, hold, use and disclose personal information for purposes connected with operating our real estate business, including to:

  • Provide real estate sales, leasing and property management services
  • Act as agent for vendors, purchasers, landlords and tenants
  • Prepare agency agreements, contracts, disclosure documents and marketing material
  • Conduct inspections, appraisals and property marketing
  • Manage trust money and comply with audit and statutory obligations
  • Verify identity, conduct customer due diligence, undertake risk assessments, and comply with our obligations under the Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) legislation, including record-keeping and reporting obligations where required by law
  • Communicate with clients and respond to enquiries
  • Maintain records required by law
  • Resolve complaints or disputes
  • Conduct marketing, client communications and business administration

In most circumstances involving property transactions, trust money, inspections or formal agreements, we are unable to deal with individuals anonymously or using a pseudonym. If you choose not to provide required personal information, we may be unable to provide certain services.

  1. Anti-Money Laundering and Counter-Terrorism Financing

As part of providing certain real estate services, we may be required to collect, verify and retain information about our clients to comply with the Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) legislation.

This may include verifying your identity, confirming ownership or authority to act, conducting customer due diligence, and, where required by law, undertaking enhanced due diligence.

We may also be required to retain records and disclose information to AUSTRAC or other government agencies where authorised or required by law. In some circumstances, we may be prohibited by law from informing an individual that such a disclosure has been made.

6. Disclosure of Personal Information

We may disclose personal information where reasonably necessary to carry out our functions, including to:

  • Our employees, contractors and authorised representatives
  • Vendors, purchasers, landlords and tenants involved in a transaction
  • Solicitors, conveyancers, strata or owners corporation managers, and financial institutions
  • IT, software, data storage, website and marketing service providers
  • Government agencies or regulators, including AUSTRAC, NSW Fair Trading and Consumer Affairs Victoria, the Australian Taxation Office, courts or other authorities where required by law

We do not sell personal information.

7. Direct Marketing

We may use personal information to provide you with marketing communications such as property alerts, newsletters and market updates.

You may opt out of receiving marketing communications at any time by:

  • Using the unsubscribe option provided, or
  • Contacting our office directly

Opting out will not affect communications required to manage an existing transaction, tenancy or agreement.

8.  Website Use and Cookies

Our website may use cookies or similar technologies to improve functionality and analyse usage. Cookies do not personally identify you.

You can disable cookies through your browser settings; however, some website features may not function as intended.

9.  Storage and Security

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure.

Personal information may be held in electronic or hard copy form. While we implement appropriate security measures, no system is completely secure, and we cannot guarantee absolute security of information transmitted online.

10.  Access, Correction and Retention

You may request access to personal information we hold about you or request correction if the information is inaccurate, incomplete or out of date.

Requests should be made in writing. We may require verification of identity before processing a request.

We may be required to retain certain records, including records required under property legislation, trust accounting requirements, taxation laws and the Anti-Money Laundering and Counter-Terrorism Financing legislation, even where a request for deletion has been made.

If you have a concern or complaint about how we handle personal information, please contact us in writing. We will investigate and respond within a reasonable timeframe.

If your complaint relates to our conduct as a licensed real estate agency, you may also contact:

  • NSW Fair Trading, or
  • Consumer Affairs Victoria, as applicable.

If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC).

12.  Minors

We do not knowingly collect personal information from individuals under the age of 18. If we become aware that such information has been collected, we will take reasonable steps to delete it.

13.  Changes to This Policy

This Privacy Policy may be updated from time to time. The most current version will be available on our website and will apply from the date of publication.
